U of O Watch mission, in the words of Foucault...

"One knows … that the university and in a general way, all teaching systems, which appear simply to disseminate knowledge, are made to maintain a certain social class in power; and to exclude the instruments of power of another social class. … It seems to me that the real political task in a society such as ours is to criticise the workings of institutions, which appear to be both neutral and independent; to criticise and attack them in such a manner that the political violence which has always exercised itself obscurely through them will be unmasked, so that one can fight against them." -- Foucault, debating Chomsky, 1971.

Doctor Donald Kilby disciplined by CPSO following allegations of sexual exploitation of sick Black foreign student at U of O

Dr. Donald Kilby accepting the Nelson Mandela Humanitarian Award in 2014.

Recent criminal charges of a medical doctor covertly filming a young female patient at University of Ottawa Health Services causes one to examine that institution.

U of O Watch has discovered that the Director of Health Services, Dr. Donald Kilby, has been disciplined by the College of Physicians and Surgeons of Ontario (CPSO) for alleged financial coercion of a Black foreign student and patient for sexual service.

In its October 19, 2017 discipline report, the CPSO puts it this way:

[...] A patient (whose country of origin is outside Canada) complained to the College that after initiating financial support for the patient’s studies in Canada, Dr. Kilby said he would not continue to support the patient unless they were sexually intimate. The patient was also concerned that Dr. Kilby treated him for a certain condition and offered to give him a related vaccine, but then said the vaccine would cost $1500; the patient also claimed that Dr. Kilby did not tell him of risks associated with the patient’s condition.

Dr. Kilby denied the patient’s claims. He said he absolutely never made any suggestion to the patient that his financial support was conditional upon entering into a sexual relationship. He acknowledged treating the patient’s condition, but said he never gave him incorrect information and that he offered the patient employment at a clinic to help pay expenses, which could include a vaccine.

[...] As to the concern that Dr. Kilby threatened to withhold funds from the patient unless they engaged in a sexual relationship, the Committee concluded that a referral to the Discipline Committee was not warranted in all the circumstances of the case, as there was no reasonable prospect of successfully prosecuting the concern.
However, the Committee stated that it did have concerns about Dr. Kilby’s overall understanding of boundaries with patients, noting:

• The investigative record describes how Dr. Kilby has funded many students to come to Canada for university education, and how (among other forms of support) he has arranged (and often paid for) things such as part-time work and housing for them.
• By Dr. Kilby’s own admission, he provided episodic treatment to the patient (whether he made statements attributed to him about a vaccine was unknown to the Committee),and he admits to treating some of the other students for whom he provided financial support.
• Dr. Kilby indicated that, on reviewing the College policy, Physician Treatment of Self, Family Members or Others Close to Them, he recognized it could be perceived that the students fell under the definition of “others close to him.”
• Dr. Kilby indicated he has taken steps to ensure he will not treat the patient and he has drafted a letter to the other students under his care advising he was making arrangements to transfer their care.

The Committee noted that while it was important that Dr. Kilby has recognized the problem in treating the students whom he sponsored and often continued to support financially, the Committee was concerned by his actions to begin with, which reflected poor judgement on his part. The Committee said it needed reassurance that Dr. Kilby will not treat these students going forward, and that he fully understands his obligations in not treating those close to him and maintaining appropriate boundaries with patients at all times. The Committee decided the two-fold disposition set out above was appropriate in all the circumstances of this case.

L'U d'O prend ses distances (St. Lewis v. Rancourt) -- La Rotonde

...and reported in English on Student's-Eye-View: LINK

“U of O insisted that it would not fund a potential lawsuit by Ms. St. Lewis against Ms. Gashoka. Recall that U of O has recognized that it is reimbursing Ms. St. Lewis’s legal fees without limit in in her pursuit against Mr. Rancourt in the name of a moral obligation and of the fact that Ms. St. Lewis was attacked for work she did as an employee. It is impossible for us to see how it would be different in Ms. Gashoka’s case, since she has been threatened with a lawsuit for having repeated and somewhat developed the ideas of Mr. Rancourt.”

Former USA Congresswoman Cynthia McKinney at University of Ottawa

Former USA Congresswoman Cynthia McKinney led a Black History Month workshop in the Rotunda of Tabaret Hall at the University of Ottawa on February 27, 2012, 7pm to 10pm.

The event was sponsored by PSAC. Co-organizers Hazel Gashoka and Jean-Marie Vianney were highly pleased with the depth and quality of the event. McKinney stressed a multicultural mosaic of allies to fight racism at the University of Ottawa. She showed awareness of local issues and brought her vast experience into play in catalyzing a search for answers.

Shamefully, university president Allan Rock was "out of the country" and left the organizers with the impression that he supported the event while his chief of staff was not even able to provide chairs. The university did provide security, following some Jewish Student Association attempts to intimidate Gashoka away from the event. McKinney is a known critic of Israeli policy against Palestinian rights.

The entire event has been posted in nine parts on YouTube:

Ibrahim Said wrongly dismissed - Medicine Dean Jacques Bradwejn biased against foreign doctor - Judge rules

(Jacques Bradwajn, Dean, Faculty of Medicine, U of O)

On December 30, 2011, a judge ruled (link HERE) in yet another case of wrongful bias and wrongful dismissal in "Canada's university's" (aka U of O) Faculty of Medicine. The national media reported on the ruling early this month:

This time the target was foreign-trained Dr. Ibrahim Said who was denied the certification to continue practicing medicine rather than being promoted to Associate Professor despite an excellent performance evaluation.

The judge is reported to have found that the Dean of the Faculty of Medicine, Dr. Jacques Bradwejn, acted with bias against Said. In my view, the circumstances were also not duly ascertained by the Faculty committee responsible to make the recommendation, which found it acceptable to go along with the Dean.

In recent years, at least five non-white doctors have been targeted by the Faculty of Medicine, with devastating career consequences. These are only the known cases that have led to court or tribunal processes.

The Rock administration has not yet seen fit to investigate or intervene but instead is in denial and funds extravagant legal defences against the plaintiffs or complainants. Not to mention the School of Nursing racial discrimination problems, HERE.

University Senate member decries alleged malfeasance at the University of Ottawa -- Three latest posts at Student-s-Eye-View

One of the few University of Ottawa senate members to consistently practice collegial governance by opposing the president Allan Rock "executive rule" era is physics graduate student Joseph Hickey.

Hickey documents his efforts to impose ethical behaviour on the Rock administration on his blog about senate: "A Student's-Eye View".

His three latest (September 11, 2011) blog posts are particularly hard hitting:::

Rancourt files Statement of Defence in Joanne St. Lewis $1 million defamation lawsuit

The Statement of Claim of University of Ottawa law professor Plaintiff Joanne St. Lewis has been posted and linked on several legal profession and other blogs and has been quoted in the mainstream media.

Today former University of Ottawa physics professor Defendant Denis Rancourt filed his Statement of Defence, following a 10-day extension, with the Ontario Superior Court of Justice: LINK-SOD.

Rancourt is self-represented.

U of O law professor Joanne St. Lewis sues Rancourt for $1 million, will give half to a law student scholarship fund

This is an update to the St. Lewis matter reported on this U of O Watch blog. As background, all related posts on the matter are HERE.

A Statement of Claim (SOC) was filed today with the Ontario Superior Court of Justice. The Court File No. for the SOC is 11-51657 and the SOC has been posted HERE (1.4 MB PDF file).

Law professor Joanne St. Lewis is suing former physics professor Denis Rancourt for $1 million dollars for the posts about St. Lewis on this blog.

It appears from the SOC that the claimed damages to St. Lewis have arisen from Google's placement of one of the U of O Watch blog articles?

Paragraph-60 of the SOC states:

"The Defendant's conduct and actions are reprehensible insulting, high-handed, spiteful, and outrageous. Such conduct warrants condemnation by this Court by means of an award of punitive damages. Professor St. Lewis will rely upon the entire conduct of the Defendant before and after the May 16, 2011 Notice to the date of judgment in this action. In the event that punitive damages are awarded against the Defendant, Professor St. Lewis will donate half of the award of punitive damages to the Danny Glover Routes To Freedom Graduate Law Student Scholarship Fund."

Another statement in the SOC (Par.51) is:

"The Defendant defamed Professor St. Lewis in furtherance of his personal animosity towards President Allan Rock and the University of Ottawa which terminated him as a Professor."

U of O student union critical race theory burnout

SFUO: Left in words, Right in deed?

UofOWatch has learned that this letter (below) was duly sent (in cc) for publication to the student paper The Fulcrum on March 26, 2011, and was simply ignored. The Fulcrum did not acknowledge or contact its author, despite the paper's statutory commitment to publish all student letters. This, for a paper that has been consistently enthusiastic to criticize the SFUO's Left politics.

It appears that at the University of Ottawa racism runs deep and crosses all race, political, age, and class boundaries...? (See all posts about racism at U of O HERE.)

UofOWatch has learned that the letter was re-sent today addressed to the present SFUO president Amalia Savva.

To Tyler Steeves,

I am writing to you as the Chair of the Student Federation of the University of Ottawa's Black History Month sub-committee in your capacity as President of the Student Federation of the University of Ottawa (SFUO).

It is with sincere regret and utter frustration that I find myself writing this letter. As a committee, we experienced a lot of resistance from the executive of the Student Federation of the University of Ottawa. We also felt as if we were being held hostage and that we had to dance to a tune in order to be heard and taken seriously.

As a representative of the committee, I first approached the SFUO in July with the plan to put certain things in motion. I had a meeting with an executive member and the response from the meeting was an email advising me that the SFUO would be "selecting members" for the 2010-2011 Black History Month Committee. This response perplexed some students who were interested in being members because we did not understand them criteria that was to be used. We also questioned the SFUO's qualifications in determining who was suitable to be on this committee. What made this response even more curious for us was the fact that for centuries marginalized groups have always been told who has the legitimacy to speak on their behalf by the dominant group.

According to the SFUO Constitution, "the SFUO Executive shall only act as a liaison between the Black History Month Committee members for financial and logistical matters". There were a few embarrassing moments that were avoidable had the SFUO executive followed their mandate as stated in the Constitution vis à vis the Black History Committee. The most embarrassing and regrettable one was suffered by our keynote speaker Dr. George Dei of Ontario Institute for Studies in Education (OISE), as he tried to check out of his hotel room.

It was also embarrassing to have to hold our event at the Carlton University Campus because of the delay in mobilizing the committee. This delay was due to SFUO's inaction in terms of setting up the committee and lack of facilitation in accessing all the resources required by the committee. The committee was also puzzled by the lack of attendance by any of the SFUO executive members.

We all have to acknowledge that the committee is seen by outsiders as representing the University of Ottawa's student body. As such any failure by the committee is seen as a failure by the whole student body. We have to work together to promote an inclusive and respectful study body at our university. The committee would like to set up a meeting with the SFUO executive to revisit the issue and come up with a more respectful working relationship.

I look forward to hearing from you in the near future.

Kindest Regards,

Hazel Gashoka
Chair, Student Federation of the University of Ottawa's Black History Month sub-committee

UofOWatch update::: Richard Dearden promises to sue

THIS unfortunate matter is not going away. The following email exchange with Canadian top lawyer Richard Dearden shows that a lawsuit against UofOWatch will follow. It also shows an aggressive lawyer not interested in discussing solutions or even providing clarifications on simple points.

[Note: It makes more sense if you read from the bottom up.]

Mr. Rancourt
1. cease communicating with my client directly - you communicate with me as counsel for Professor St. Lewis.
2. i attach [LINK] my May 20th letter to you which is the second Notice i was referring to in my email to you today.
3. there is nothing to clarify regarding your defamatory statements - you take down your defamatory blogs immediately and then i will consider meeting with you to discuss the wording of your unequivocal retraction and apology to Professor St. Lewis that you will publish on your blog. That may assist in mitigating the damages you have caused her.
4. as for your para 4 below, the Statement of Claim that will be issued against you should answer your questions. Once again i strongly recommend that you retain a lawyer to defend the defamatory statements you continue to repeat and add to (such as the statements in para 5 below that are false and defamatory). I am informing you to not repeat the accusations in para 5 below to any third party. To do so will be malicious and further aggravate my client's damages.

Dear Mr. Dearden,

Thank you for your reply. Clarifications are needed in this matter.

(1) Since you have not indicated that you would inform your client about my May 20th offer to publish her response, I have put Ms. St. Lewis in cc. This will also make Ms. St. Lewis fully aware of our exchange.

(2) Without implying guilt or blame on any party, I continue to seek a meeting to help clarify and resolve this matter, as I have indicated.

(3) In your today's email, you state "I have served you with two Notices demanding..." yet your letter of May 16, 2011, is the only paper communication that I have ever received from you (and in which you make no mention of a previous communication). Are you counting your email of 11:54am today as having served me a second "Notice"? Please clarify.

(4) Please clarify the nature of any legal action that you may be contemplating. I note that you do not refer to any specific law or legal principle that would have been violated. In the absence of any allegations of my having violated a specific common law or Act, please clarify the legal basis of the apology that you are now demanding and that was not mentioned in your letter of May 16, 2011.

(5) I am concerned that you or your client Joanne St. Lewis have obtained my unlisted personal home address. Please inform me how you obtained my personal information. In particular, I am concerned that my former employer the University of Ottawa could have illegally or improperly released my personal and former employee information to you and your client Joanne St. Lewis.

(6) Please acknowledge receiving the present email communication.

Sincerely,
Denis Rancourt

Report on racism at the School of Nursing - today's press conference and Michaelle Jean

[April 29, 2011, press conference participants]

The Centre for Equity and Human Rights (CEHR) of the Student Federation of the University of Ottawa (SFUO) held its press conference about the racism in the U of O School of Nursing today.

The CEHR has received twenty racism discrimination complaints from students in the School of Nursing since 2009.

The press conference testimonies by two plaintiffs were detailed and disturbing.

There can be no doubt that Nursing has an urgent and widespread racism problem that has been disregarded for years by the university administration.

The lawyer for the plaintiffs Yavar Hameed stressed that the problem was not only from bad management but was also systemic, pointing to a lack of internal structures to solve and correct racism problems.

Unlike previous press conferences at the University of Ottawa, the university communication staff and legal counsel were nowhere to be seen on the floor. Instead, they have installed a new electronic lock on their main door and called the media behind closed doors for private conferences.

The presenters avoided naming the six university staff complained against in the Human Rights Tribunal of Ontario complaints but Student Appeal Centre director Mireille Gervais had the following statements for UofOWatch.

"[Professor] Isabelle Cyr is a problem regarding differential treatment of Nursing students based on the colour of their skin."

"Kirsten Woolend, ex-director of the School of Nursing, acknowledged in 2008 -- at a meeting with me, CEHR director Francine Page, SFUO VP-University Seamus Wolfe, vice-dean of the Faculty of Health Sciences Francis Reardon, and School of Nursing administrator of undergraduate programs Joanne Larose-Dubois -- that the School of Nursing had received many complaints about Isabelle Cyr."

"It is a widely known fact that Isabelle Cyr once physically shook [assaulted] a black Nursing student."

As the event was closing, former Governor General Michaelle Jean, who now has her UNESCO office beside university president Allan Rock's office, happened by accident to walk by and stopped to chat with some of the plaintiffs. Jean inquired why they were in Tabaret Hall. After some explanation Jean asked CEHR director Francine Page to send her all the documents so she can prepare for a possible informal chat with Rock. Maybe Rock will listen to Jean? He hasn't listened to anyone else.

Rampant racism at the U of O School of Nursing::: Press conference announced

The Centre for Equity and Human Rights (CEHR) of the Student Federation of the University of Ottawa (SFUO) has announced that it will hold a press conference about the racism in the U of O School of Nursing:

PRESS CONFERENCE
Friday April 29, 2011
11 AM
Entrance rotunda, Tabaret Hall
550 Cumberland

Former School of Nursing students Anne Mpinda and Victor Ndayishimiye have each filed detailed human rights complaints with the Human Rights Tribunal of Ontario (HRTO) against six teaching and administrative staff members at the school. They are represented by human rights lawyer Yavar Hameed.

The HRTO complaints are about racial discrimination and allege systemic discrimination, reprisals and intimidation; not unlike the recent high-profile cases in the U of O Faculty of Medicine, HERE.

The CEHR also confirms that it has received no less than twenty such similar reports from students in the School of Nursing since the fall of 2009.

The director of the CEHR, Francine Page, had sounded the alarm in 2007 and followed this with an expert report to the University in February 2010. Page was disturbed to find her concerns and report effectively ignored by the University of Ottawa, under its president Allan Rock administration.

The University propaganda touts Rock as a "defender of human rights" "putting the University at the service of the world". It would be better to put itself at the service of its students, especially those being discriminated against.

The CEHR press release comes only weeks after Allan Rock's university senate brazenly repudiated a motion to reaffirm its commitment to a discrimination-free academic environment, in an effort to prevent exactly these types of problems, HERE.

Needless to say, the Student Appeal Centre's (SAC) 2008 public report about systemic racism at the University of Ottawa, that the Rock administration took great pains to deny and defame (HERE), now echos loudly in the hollow halls of this racist institution.

On his next mission abroad, Rock could save a lot of folks a lot of pain by plainly stating: "If you're black or brown avoid applying." Or, he could start actually standing for human rights by ordering immediate reparations where reparations are due rather than fight lengthy and costly denials of the obvious -- as the University shamefully continues to do.

Update: Senate member Joseph Hickey is following up with university senate, HERE. The University of Ottawa ("Canada's university" in its propaganda) is rather unique in Canada for not having a policy against harassment and discrimination. This absence of protection has repeatedly been denounced by the SEHR and SAC of the SFUO.

U of O students::: What can you do about this? -- Malfeasance in Medicine

Dear students of the University of Ottawa:

I am in the process of sending the following message to each and every staff member of the University of Ottawa, 5000 professors, administrators, technicians, etc.

I am asking your professors to stand up for what is right when an obvious and serious malfeasance occurs in academia, on our very own campus.

I ask that you also consider what you can do individually or in groups to right this wrong... Ask your professors if they got the email yet and how they are considering responding... Imagine if this happened to you after you graduate.

Let's fix the big obvious things we can.

HERE IS THE MESSAGE I'M SENDING:

Dear colleagues of the University of Ottawa:

Maybe you have seen the recent national and regional news reports about the U of O Faculty of Medicine firings of three talented medical doctors?

Such as this Globe and Mail article:
LINK-G&M

And these two major Ottawa-Citizen stories:
LINK-OC-1
LINK-OC-2

This is a very disturbing situation where administrative malfeasance is apparent in documented emails and where doctors were fired as reprisals for making complaints.

The malfeasance is so evident and so extreme in this case that it damages the public trust.
The specific incidences of malfeasance are also morally condemnable.
And it has produced unacceptable damage to at least three of our colleagues.

I therefore urge you to consider how you can personally contribute to pressuring or convincing the Allan Rock administration to repair the situation immediately rather than to use the protracted tribunal and court cases as a pretext to not act, and thereby effectively condone the administrative actions.

As background, here are critical blog reports (and video reports) that I have posted about this horrific situation:
LINK-blog-1
LINK-blog-2
LINK-blog-3

Some of the leaked emails are posted here:
http://academicfreedom.ca/doctors/

I hope that you will be able to act individually and as groups to pressure the administration of our university, that seems intent on inaction in the face of prima facie malfeasance.

I understand that the academic implications of this matter are going to be discussed at the next meeting of university Senate.

Please contact me if you wish more information or to discuss this situation.

Sincerely,
Denis Rancourt, B.Sc., M.Sc., Ph.D.

Three medical doctors jointly file human rights complaints against the University of Ottawa and several officials -- PRESS RELEASE

U of O's systemic racism confirmed in spades

Dr. Waleed AlGhaithy (Neurosurgery Residency Program, University of Ottawa), Dr. Khalid Aba-Alkhail (Cardiac Surgery Residency Program) and Dr. Ms. Manal Al-Saigh (same) have filed Human Rights Tribunal of Ontario complaints against the University of Ottawa and several officials.

They are represented by freedom of expression and human rights lawyer Douglas Christie. (video-1) (video-2)

A joint press conference will be held at 10:30am on Wednesday March 9, 2011, in the entrance rotunda of Tabaret Hall (central administration building), 550 Cumberland Ave., University of Ottawa. [FACEBOOK EVENT LINK]

Discrimination, reprisal, and intimidation are alleged on the basis of evidence filed with the Tribunal.

Dr. Aba-Alkail affirms that Senator Dr. Wilbert Keon, Dr. Paul Bragg, Dr. James Worthington, Dr. Thierry Mesana, and others collectively intimidated him behind closed doors to drop a legal reparation case under threat of career obliteration.

The evidence for reprisal and targeting is unambiguous in the form of emails between hospital executives, including emails leaked by an inside source and sent to hundreds of faculty and residents.

For example, on July 11, 2009, Chairman of Neurosurgery Richard Moulton wrote to Dr. Paul Bragg (Associate Dean PGME) and Dr. James Worthington (VP Medical Affairs of TOH) about plaintiff Dr. AlGaithy:

“If the [discrimination] complaint against [Dr. Eve Tsai] is dismissed there are going to have to be some significant consequences for the involved parties (dismissal/suspension) or we are going to be facing this ad infinitum.”

AlGaithy was summarily dismissed despite his outstanding academic and professional standing.

The March 9th press conference is organized by the Student Appeal Centre (SAC) of the Student Federation University of Ottawa (SFUO), following the SAC’s 2008 report about systemic racism at the University of Ottawa.

This blogpost has been removed

This blogpost has been removed on June 7, 2014, pursuant to a June 6, 2014 court order of Justice Michel Charbonneau, in the St. Lewis v. Rancourt defamation lawsuit heard in Ottawa, as has been reported in the media.

The Defendant will appeal the court orders, if he is able to raise the money for the required court transcripts (approximately $20,000.), and if he can find a lawyer to act pro bono in the appeal that would be heard in Toronto.
