U of O Watch mission, in the words of Foucault...

"One knows … that the university and in a general way, all teaching systems, which appear simply to disseminate knowledge, are made to maintain a certain social class in power; and to exclude the instruments of power of another social class. … It seems to me that the real political task in a society such as ours is to criticise the workings of institutions, which appear to be both neutral and independent; to criticise and attack them in such a manner that the political violence which has always exercised itself obscurely through them will be unmasked, so that one can fight against them." -- Foucault, debating Chomsky, 1971.

The 2013 IRON FIST award goes to Julie Beauchamp, most ruthless administrator of students, says SAC-SFUO

Julie Beauchamp, Telfer School of Management
Every year the Student Appeal Centre (SAC) of the Student Federation of the University of Ottawa (SFUO) selects one U of O administrator to be named for, in the SAC-SFUO's opinion, being "ruthless", having "contempt for student rights", and displaying an "overall lack of fairness".

The opening paragraph of the 2013 award description reads (LINK-SFUO-web-site):

"After careful consideration among many contenders, the Student Appeal Centre of the Student Federation of the University of Ottawa awards the Iron Fist for the most unjust University of Ottawa Administrator to Julie Beauchamp, Director of Undergraduate Studies, Telfer School of Management. Ms. Beauchamp’s actions meet the criteria for the Iron Fist award which include ruthlessness, contempt for student rights, and overall lack of fairness in decision making." [Emphasis added.]

The SFUO award description details the SAC-SFUO's stated reasons for its choice of Ms. Beauchamp.

The past winners of the SAC-SFUO Iron Fist are Marie-Josée Berger (2011) and Thiery Giordano (2012).

U of O Watch welcomes all comments, including any full response from Ms. Beauchamp.

L'U d'O prend ses distances (St. Lewis v. Rancourt) -- La Rotonde

...and reported in English on Student's-Eye-View: LINK

“U of O insisted that it would not fund a potential lawsuit by Ms. St. Lewis against Ms. Gashoka. Recall that U of O has recognized that it is reimbursing Ms. St. Lewis’s legal fees without limit in in her pursuit against Mr. Rancourt in the name of a moral obligation and of the fact that Ms. St. Lewis was attacked for work she did as an employee. It is impossible for us to see how it would be different in Ms. Gashoka’s case, since she has been threatened with a lawsuit for having repeated and somewhat developed the ideas of Mr. Rancourt.”

St. Lewis v. Rancourt::: IN A NUTSHELL

This is a brief explanation of the St. Lewis v. Rancourt defamation lawsuit presently before the Ontario Superior Court of Justice.

SUMMARY -- In 2008 the student union released a public report about systemic racism at the University of Ottawa. The University asked a black professor expert to assess the student report in a responding public report. The expert found that there was no basis for affirming systemic racism at the University of Ottawa. A white former physics professor runs a blog critical of the University of Ottawa and of its (white) president. The physics professor was critical of the expert's report in a 2008 blogpost. After the student union released relevant access to information documents in 2011, the physics professor blogged again stating that the access to information documents suggested that the expert had [COURT ORDER]. The expert obtained funding for a lawsuit from the university president, and then sued the physics professor for $1 million in a defamation action, without disclosing the university funding. The university was later obliged to disclose its involvement and the president's role in the on-going lawsuit.

Denis Rancourt is a former tenured Full Professor of physics, University of Ottawa. He has run the "U of O Watch" blog, critical of the University of Ottawa, since 2007. Rancourt was dismissed from his full professorship in 2009, after 23 years. The dismissal is presently in binding labour arbitration where the hearings are scheduled to continue until June 2013.

In 2008, the student union at the University of Ottawa published a report ("the SAC report", Student Appeal Centre) alleging systemic racism in the University's treatment of academic fraud, based on the SAC's data and on case studies. This SAC report immediately attracted media attention.

The University asked tenured Assistant Professor of law Joanne St. Lewis, then Director of the University's Human Rights Research and Education Centre, to write an evaluation ("the St. Lewis report") of the SAC report. The completed St. Lewis report was announced on the University web site and Professor St. Lewis did media interviews about her report.

The St. Lewis report was critical of the SAC report, found, in part, that

"The short answer for this evaluator on whether there is systemic racism in the administration of the Academic Fraud process at the University of Ottawa is: I don’t know. What I do know, is that this report does not establish this in any measurable or analytically plausible fashion."

and made ten recommendations, as "The Way Forward".

In 2008, Rancourt made a critical assessment of the St. Lewis report on his blog. The post was entitled "Rock Administration Prefers to Confuse “Independent” with “Internal” Rather Than Address Systemic Racism".

In 2011, the SAC posted documents about the St. Lewis report, which it had obtained via an access to information request, to the SAC blog.

In 2011, Rancourt posted another blog article critical of the St. Lewis report, based on the newly released access to information documents. This second blog article was entitled "[COURT ORDER]" and it stated, in part (see p.9, HERE):

"[COURT ORDER]"

The later blogpost gave rise to a $1 million defamation lawsuit against Rancourt, initiated by St. Lewis, see June 23, 2011 Statement of Claim.

As one defence, Rancourt argued that if this lawsuit was a proxy lawsuit by the University, then it violated his Charter rights by suppressing his criticism of a public institution, see p.20-21 of the Statement of Defence.

Rancourt sought to discover if the University of Ottawa was funding the St. Lewis litigation. This question was pursued and even was asked at the University's Senate via a student senator's motion (LINK).

The University replied on October 25, 2011, via hired lawyer David Scott, that it was indeed funding the St. Lewis litigation against Rancourt. A report on the efforts to obtain this reply is here: LINK. Scott's letter states, in part:

"Furthermore, your outrageously racist attack upon her takes this case out of the ordinary and, in the view of the University, alone creates a moral obligation to provide support for her in defence of her reputation."

Following this reply, Rancourt brought a motion that the action be stayed or dismissed for abuse of process (see Notice of Motion). The later motion is presently in process (LINK to report about motion).

As part of the later "champerty" motion, Rancourt cross-examined university president Allan Rock who testified under oath that he had made the decision in April 2011 to fund the St. Lewis lawsuit "without a cap" (with no funding limit) from the University's operating budget (see Transcript of the cross-examination).

Rancourt's "champerty" motion will be heard on August 29, 2011, following Rancourt's on-going "refusals and productions" motion to obtain answers that the cross-examined witnesses have refused to give.

In the first day of Rancourt's "refusals and productions" motion, on June 20, 2012, Rancourt was not allowed to cross-examine a recent affiant put forward by the University of Ottawa to counter the "refusals and productions" motion. In addition, Rancourt had put forward an expert's affidavit to establish the authenticity of a document showing a March 2012 email communication from Allan Rock to St. Lewis' counsel Richard Dearden. The expert's affidavit was stated to be inadmissible for reasons that Rancourt expects will be explained in the Judge's decision about the "refusals and productions" motion.

The "refusals and productions" motion resumes in court on July 24, 2012.

Robert:

I think the report is very well done. My only concern is with the first recommendation, the wording of which seems to assume that there is some racism present already. Since Professor St. Lewis has already concluded that there is no evidence of it, such wording is wrong and inconsistent with her own report.

Apart from that, the report looks very sound. I assume any press release will say that we are going to study the recommendations, since we have to consult the Senate and other interested parties before committing to the time limits and other recommended changes.

One last point. I would like Robert to be the only point of contact for us with Professor St. Lewis. Although her report is excellent, it may be criticized as not being "independent" from the administration. So far, our dealings with her have been through Robert and have been scrupulously objective. We have simply sought her view, and have imposed no limitations, contraints or conditions. She has been entirely free to say anything she wants. In order to maintain this professional and objective relationship with her, I want Robert to be the only one in communication with her. Robert can simply observe that the first recommendation seems inconsitent with her findings. It will then be up to professor St. Lewis to decide whether to make a change. If a number of people all send emails and call, we will lose that focus of professionalism and independence.

I will take this matter up with CA at noon today. Robert, will you be able to plug in by phone?

Allan

U of O student Mahdi Darius Nazemroya in life-threatening danger in Tripoli -- PRESS RELEASE

Background article: The Truth About the Situation in Libya

Ottawa – August 22, 2011 :
University of Ottawa student and independent journalist currently in Tripoli fears for his life

At 11:27am today, Mireille Gervais, Director of the Student Appeal Centre (Student Federation of the University of Ottawa) received a phone call from Mahdi Darius Nazemroya, a Canadian citizen and independent journalist who indicated that he was currently hiding in the Tripoli hotel Rixos Al Nasr, fearing for his life. Mr. Nazemroya, a client of the Student Appeal Centre, asked Mrs. Gervais to do everything in her power to “get me out of here”. He feared that he may be dead at any moment and asked that Canadian Foreign Affairs intervene to save his life.

Mr. Nazemroya further indicated that he had not slept in three days and was hiding in the hotel with other journalists.

The Student Appeal Centre calls on federal authorities to do everything in their power to obtain the safety of the un-imbedded journalists and humanitarian observers who have sought refuge in the Rixos Al Nasr hotel in Tripoli.

Mahdi Darius Nazemroya studies political science and anthropology and he is a past Ombudsman of the Englissh-language student newspaper. He has been a dedicated contributor to student and alternative media for many years.

Rancourt files Statement of Defence in Joanne St. Lewis $1 million defamation lawsuit

The Statement of Claim of University of Ottawa law professor Plaintiff Joanne St. Lewis has been posted and linked on several legal profession and other blogs and has been quoted in the mainstream media.

Today former University of Ottawa physics professor Defendant Denis Rancourt filed his Statement of Defence, following a 10-day extension, with the Ontario Superior Court of Justice: LINK-SOD.

Rancourt is self-represented.

The casual reader should note that several words such as "malice", "frivolous" and "vexatious", for example, have legal meanings determined by case law.

Marie Josée Berger most ruthless administrator at U of O, student union says

[Photo (uOttawa.ca) : dean Marie Josée Berger]

The Student Appeal Centre (SAC) of the Student Federation of the University of Ottawa (SFUO) has named the dean of the Faculty of Education, Marie Josée Berger, as the first recipient of its newly inaugurated annual "Iron Fist Award".

The SAC has announced the prize on its blog where its report reads in part (LINK):

The Iron Fist is awarded to the University of Ottawa Administrator having caught Student Appeal Officers’ attention for being most ruthless and/or unjust while showing little or no respect for students. The Award considers both long-term career contributions and particularly notable specific events.

In this case, Marie Josée Berger is well deserving of the Award, having been the object of several informal complaints at the Student Appeal Centre over many years.

For the 2010-2011 school year highlights include Marie Josée Berger’s refusal to respond and investigate at least three very serious complaints filed with her office, calling a student to her office only to belittle her after the case was already resolved in favour of the student, and threatening to impede her own graduate student’s progress in the program when the student expressed her desire to change supervisors.

Past conflicts involving Berger have included harsh unjustified discipline and dismissals against several academic staff members of the Faculty of Education.

At one point an anonymous letter from several professors published in a student newspaper accused Berger of ruling the Faculty of Education in "Tonton Macoute" style. Berger threatened to sue the student paper and went on a rampage against several professors.

The notorious reputation of Berger's Faculty of Education is at least campus wide.

Characteristically, in 2009 the university's Allan Rock administration named Berger a "Celebrat[ed] extraordinary woman at the University of Ottawa".

Youtube video with Berger (and Allan Rock in the monarchy of Morocco) on the topic of dialogue:

In the video, Berger explains that she is also interested in buying gold at a good price and that she is thankful for the advice she received in this regard.

Vicious reprisals in the Faculty of Medicine::: U of O damage-control spin insufficient

Systemic racism in the Faculty of Medicine, University of Ottawa, has been exposed via leaked emails and at a press conference yesterday and is national news today: Globe and Mail.

The press conference was attended by all the major radio, TV and press media in Ottawa and followed THIS press release.

In 2008 when the Student Appeal Centre (SAC) of the student union first publicly exposed the problem of systemic racism at the University of Ottawa, the university's response was a campaign of denigration and cover up personally managed by president Allan Rock, as seen in access to information documents obtained by the SAC (HERE and HERE and links therein).

At the Wednesday press conference in the rotunda of the central administration building, president Allan Rock - as usual for hot issues of public concern - was nowhere to be found (although he had been invited) but an eight-person university legal and public relations team was buzzing with activity.

Their mission was to develop and deliver the University spin - the optimized tactical message that would minimize the university's responsibility.

Their previous (2008) university reaction (to deny, denigrate, and cover up) was now evidently a failure.

In addition, the University was now exposed to an even greater threat than being shown to be racist: Some of its top officials in the Faculty of Medicine participated in vicious reprisal against at least one talented MD, for filing an internal human rights complaint and as a way to quell possible external complaints. In particular, see THIS leaked email:

Eve [Dr. Eve Tsai],

It is uncertain whether Al-Ghaithy et al. would take this matter further to an external body such as the Human Rights Tribunal. However, I can predict with certainty that fixing Al-Ghaithy would deter the others from doing so. I have had discussions with the Dean and Chief of Surgery and the consensus is that Al-Ghaithy must be removed. Over the last few months I have been working closely with Dr. Worthington and Dr. Bragg, and let me assure you that we are not that far. You have to appreciate here that we are dealing with a strong resident and probably the best we have, at least from an academic perspective. This together with his popularity among the residents made some of the conventional methods unsuccessful.

At the end of the day the University will not sacrifice one of its faculty members for the sake of few disgruntled out-funded residents, and I doubt it very much that the other complainants would prosecute you outside the campus in a process that is naturally protracted and financially draining.

Rick [Dr. Richard Moulton, Association Professor University of Ottawa; Chair, Division of Neurosurgery University of Ottawa; Chief, Division of Neurosurgery The Ottawa Hospital; Program Director, Division of Neurosurgery]

The university's final spin solution was a damage-control compromise: Turn attention away from the grotesque malfeasance of its Faculty of Medicine officials by admitting that the allegations of racist discrimination are "very serious" and by turning attention towards the Human Rights Tribunal process: "The university feels that's the proper forum where we will speak out."

Turn attention away from the illegal reprisals practiced by Moulton and several others (Dean of Medical School, Paul Bragg Associate Dean PGME, Chief of Surgery Eric Paulin, Jim Worthington TOH VP-Medical Affairs) and towards an examination of the allegations of racist discrimination.

Brilliant! But somehow the elephant in the room may confront Allan Rock sooner than he would like. At the moment, Richard Moulton's actions are not even subject to an internal discipline investigation. He would have been in more trouble if he had given high grades to some "out-sourced" medical residents...?

Youtube videos of the press conference and its question period are being uploaded by university senator Joseph Hickey who has taken the matter to university Senate. Here is the presentation by the plaintiffs' spokesperson and co-plaintiff Dr. Khalid Aba-Alkhail:

Three medical doctors jointly file human rights complaints against the University of Ottawa and several officials -- PRESS RELEASE

U of O's systemic racism confirmed in spades

Dr. Waleed AlGhaithy (Neurosurgery Residency Program, University of Ottawa), Dr. Khalid Aba-Alkhail (Cardiac Surgery Residency Program) and Dr. Ms. Manal Al-Saigh (same) have filed Human Rights Tribunal of Ontario complaints against the University of Ottawa and several officials.

They are represented by freedom of expression and human rights lawyer Douglas Christie. (video-1) (video-2)

A joint press conference will be held at 10:30am on Wednesday March 9, 2011, in the entrance rotunda of Tabaret Hall (central administration building), 550 Cumberland Ave., University of Ottawa. [FACEBOOK EVENT LINK]

Discrimination, reprisal, and intimidation are alleged on the basis of evidence filed with the Tribunal.

Dr. Aba-Alkail affirms that Senator Dr. Wilbert Keon, Dr. Paul Bragg, Dr. James Worthington, Dr. Thierry Mesana, and others collectively intimidated him behind closed doors to drop a legal reparation case under threat of career obliteration.

The evidence for reprisal and targeting is unambiguous in the form of emails between hospital executives, including emails leaked by an inside source and sent to hundreds of faculty and residents.

For example, on July 11, 2009, Chairman of Neurosurgery Richard Moulton wrote to Dr. Paul Bragg (Associate Dean PGME) and Dr. James Worthington (VP Medical Affairs of TOH) about plaintiff Dr. AlGaithy:

“If the [discrimination] complaint against [Dr. Eve Tsai] is dismissed there are going to have to be some significant consequences for the involved parties (dismissal/suspension) or we are going to be facing this ad infinitum.”

AlGaithy was summarily dismissed despite his outstanding academic and professional standing.

The March 9th press conference is organized by the Student Appeal Centre (SAC) of the Student Federation University of Ottawa (SFUO), following the SAC’s 2008 report about systemic racism at the University of Ottawa.

This blogpost has been removed

This blogpost has been removed on June 7, 2014, pursuant to a June 6, 2014 court order of Justice Michel Charbonneau, in the St. Lewis v. Rancourt defamation lawsuit heard in Ottawa, as has been reported in the media.

The Defendant will appeal the court orders, if he is able to raise the money for the required court transcripts (approximately $20,000.), and if he can find a lawyer to act pro bono in the appeal that would be heard in Toronto.

BREAKING NEWS::: Student Marc Kelly wins trespass trial - Cops, University, Crown were wrong

[Photo: Marc Kelly through the window of the SFUO-SAC office just before Ottawa Police barged in to arrest him.]

OTTAWA, December 14, 2010: Marc Kelly court decision released - victory for students and for student sovereignty over student space.

The February 2, 2010, campus arrests of mathematics-physics student Marc Kelly and student union president Seamus Wolfe at the University of Ottawa were depicted in two popular Youtube videos (HERE, HERE) and were reported in the national media HERE.

(The videos were made by student University Senate member Joseph Hickey.)

By using a student union lawyer to bargain for diversion (community service), Wolfe effectively admitted guilt to the false-arrest charge of "disturbing the peace by swearing" for saying "fuck face" under his breath to the Ottawa Police sergeant on the scene (Sgt. Mallet) who had overseen the false-arrest of Kelly.
Kelly pleaded not guilty, went to trial self-represented against the Crown, the cops, the University, and University Legal Counsel Alain Roussy who attended the entire trial, and won in a precedent-setting ruling released today by judge L. Girault at the Provincial Offenses Court in Ottawa, Ontario.
The charge was trespass despite the fact that Kelly was in the Student Appeal Centre (SAC) office of the student union consulting on the University's illegitimate trespass order against him.

The scholarship student had previously been unilaterally de-registered from his study program and exiled from campus without justification (HERE) by a vindictive administration that did not take kindly to Kelly's well known (and TV-broadcast) direct appeal to president Allan Rock, revealing Rock to be verbally abusive (HERE).

The ruling establishes what should have been obvious to Roussy (or co-Counsel Kathryn Prud'homme, who informed the police otherwise) that the student union, the Student Federation University of Ottawa (SFUO), not the University is the legal occupier of SFUO offices.

Indeed, Roussy and Prud'homme were in the possession of an agreement between the SFUO and the University of Ottawa, signed at the highest university level (VP-Resources), which explicitly stated that the SFUO was the legal occupier. (Arguably the SFUO still owns the University Centre!)

The main part of the trial had been held on December 2, 2010, where an impressive array of large men and women in and out of bullet proof vests testified or were present to testify against Kelly:
  • Claude Giroux, campus police chief
  • D. Levesque, Ottawa Police
  • Nicholas Lavoie, campus police
  • Ryan Macdonald, campus police
  • Alexander Macpherson, campus police
  • Brian Vissers, spy camera coordinator, university
  • Nathalie Charlebois, lead investigator, campus police
  • Sgt. Mallet, Ottawa Police (not present on Dec.2nd)
In addition, Roussy attended the trial and consulted with Crown lawyer Bruce Lee-Shanok, and dean of the Faculty of Science Andre E. Lalonde had been subpoenaed but was on call in lieu of showing.

Lalonde had spotted Kelly in the SAC office on February 2nd and, apparently recognizing the significant and immediate danger to the institution, had called campus security presumably in a panic.

The behaviours of Roussy/Prud'homme and Lalonde were unprofessional but so was that of Ottawa Police.

The Ottawa Police consulted only Roussy/Prud'homme and disregarded the the clear and repeated legal occupancy information provided to them by SAC Director Mireille Gervais (a law graduate), SFUO President Seamus Wolfe and teacher assistant union (CUPE Local 2626) President Sean Kelly (see video). Ottawa Police then told the SFUO president they would wait for him to produce the rental contract of the office space and then five minutes later (see video) forced their way into the SAC office without a warrant and arrested Kelly.

After that, you wonder why they didn't also knee him in the thigh repeatedly and strip search him?

In addition, Constable D. Levesque of Ottawa Police blatantly lied under oath at the December 2nd trial hearing. He said he had an excellent memory of the events and that he had most definitely watched the Youtube video but that he himself had not asked for the rental contract (see 54 seconds into the video when he clearly asks Wolfe for the rental contract). Levesque added that if he had received the contract he would have reconsidered the arrest but that he had already waited (he inferred from his notes) approximately 29 minutes (see video, less than 5 minutes passed between asking for the contract and the decision to arrest). One wonders what Constable Levesque's testimony would be like if he did not have an "excellent" memory additionally supported by an unedited Youtube video that he watched?

At trial Judge L. Girault refused to look at the video that Kelly repeatedly asked to show to the court and that would have established the many improper actions of the police and Levesque's perjury.

If judges don't show initiative in examining police behaviour then students on campuses will continue to be mistreated by Ottawa's finest only too happy to serve the Rock administration.

Nonetheless, Kelly's closing arguments (delivered after he was arrested in court at lunch recess on December 2nd on unrelated charges of failing to appear in court!) were sharp and legalistic, leaving the court little room to find him guilty.

This case is precedent setting: The SFUO is the legal occupier of its premises. You can thank Marc Kelly.

Allan Rock poster boy for most ruthless treatment of students

The Student Appeals Centre (SAC) of the student union (Student Federation University of Ottawa, SFUO) has launched its first annual "Iron Fist Award" for the most ruthless administrator in treating students.

Guess who the poster boy is for this notorious award?

Yup, Allan Rock. Not a difficult choice given the man's on-campus history, HERE, and given his administration's treatment of U of O students reported every year by the SAC, HERE.

The initiation of the Iron Fist Award and Allan Rock's response to the official SAC poster (above) are reported in the student newspaper LINK:
"University of Ottawa President Allan Rock had no comments on the posters, explaining that it was freedom of expression and that he was not concerned about the images of his face being used in the campaign."
It is heartening to note that Mr. Rock is learning about freedom of expression following his past banning of a student poster, his strong-arming of a former SFUO president to adopt a recommended political view, and the fiasco that he engineered around the Ann Coulter affair.

Prosecutors fumble in Marc Kelly trial

Will the media cover this or will it prefer to stick with the U of O banned bottled water story?

SOME BACKGROUND

Remember these remarkable videos about ludicrous arrests of students on the campus of the University of Ottawa?

One student (Seamus Wolf, then president of the student union) plea bargained. Student Marc Kelly did not plea bargain and is representing himself at his own trial.

Kelly, a former scholarship student in mathematics-physics, was arbitrarily barred from registering for courses to finish his B.Sc. degree, expelled from his program of study, and trespassed from all University of Ottawa grounds by the Allan Rock administration.

The Student Appeal Center (SAC) of the student union is defending Kelly's academic rights and Kelly was in the SAC office when he was arrested for trespass after the dean of the Faculty of Science Andre E. Lalonde called police on spotting Kelly in the SAC office.

Ludicrous.

Allan Rock has a history of confrontation with student Kelly: HERE.

Several background articles about the Marc Kelly case at the University of Ottawa are HERE.

RECENT DEVELOPMENT

On Monday September 4, 2010, Marc Kelly was in court at 9 am to defend himself over the false arrest ordered by the Rock administration.

Well the Prosecutor had to ask the judge for an adjournment because she "only realized late Friday" that, after months of preparation, her office had not subpoenaed her witnesses (the many Ottawa Police and campus police officers involved at the scene or in the background).

The Judge ruled that an adjournment was granted but that the onus was now on the Prosecutor to produce her witnesses at the next trial date which was set for:

9 am, Monday October 4, 2010.
Courtroom 101
100 Constellation Crescent, Ottawa, Ontario.

This means that the Prosecutor will either be ready for trial or the charges will be dropped.

Kelly had obtained a subpoena order for dean Andre E. Lalonde but this order will now need to be re-issued for the new trial date.

If the charges are dropped or beat this will open the door for Kelly to then sue for malicious arrest.

Either way, it will be a long road to the B.Sc.

U of O student found not guilty of Trespass on University property

OTTAWA, June 2, 2010 – U of O Master’s student and Senate member-elect Joseph Hickey was found not guilty today of a politically motivated charge under the Trespass to Property Act. Mr. Hickey is the second student politician in the past year to be trespassed by the Rock administration from all U of O lands and buildings.

Mr. Hickey, represented pro bono by Caroline Cyr of Crystal Criminal Law Office, was arrested and removed from campus on December 11, 2009 while booking an appointment with President Allan Rock to have the no trespassing notice revoked.

Ex-minister of Justice Mr. Rock, Vice President Diane Davidson, and their legal counsel Alain Roussy were subpoenaed to appear as witnesses but were not needed once the prosecutor Terry Callaghan, after contacting the university, reported to Mr. Hickey’s lawyer that she would present no evidence at trial.
“The university has developed a habit of arresting and charging students only to contact the Crown Attorney’s office and have all charges dropped as soon as its executives have been subpoenaed to take the stand in open court. This is another incidence of irresponsible institutional behaviour by an administration that shoots first and then avoids the questions six months later,”
said the scholarship graduate student, who is also a Teaching Assistant and member-elect of the university Senate.
“What is going on between the police and the university when the administration can repeatedly have students handcuffed and arrested and then never answer to it in court? I will work hard at Senate to get to the bottom of the university’s continuing abuse of the legal system to attack its students. Our fundamental freedoms must be protected, especially on campus”
he continued.

The U of O Senate has a vibrant history, such as the December 1, 2008 arrest of two-time Student Union presidential candidate Marc Kelly who was banned from all of campus after he video recorded a Senate meeting. Following student protests, all Senate meetings are now video recorded and broadcast online, making it possible for everyone to tune-in and watch.

Ms. Cyr will continue to defend Joseph Hickey against a criminal charge that he participated in the painting of the message “These Walls Belong to Students” on a blank campus billboard wall on December 7, 2009. A full-day trial has been set for February 2, 2011.

U of O's Rock actuates a complete exile of math student Marc Kelly

Hemlock or exile?

Those were the only two choices provided by former Minister of Justice now university president Allan Rock.

Rock's conflict with student Marc Kelly has been described HERE and recently in a detailed report by Stephen Lendman HERE. The Ottawa corporate media have also recently reported Kelly's banishment HERE and HERE (today).

Allan Rock's recorded November 3rd 2008 verbal abuse and intimidation of Kelly was made public HERE and by mass email:

But now exile - a complete ban on associating or communicating with all 50,000 members of the university community.

The Student Appeal Centre (SAC) of the student union is leading Kelly's defense and has put out this press release:

U of O’s Rock administration exiles student from all communications

OTTAWA, April 14, 2010 – Following Monday’s arrest of University of Ottawa math student Marc Kelly and a 24 hour detention in jail, Ottawa Police have imposed an unprecedented restriction:

Under the threat of immediate jailing until trial, Kelly is required to abstain from communication or associating directly, indirectly, or electronically, with all students and staff of the university.

The arrest was for an alleged violation of unjustified trespass from the public institution, contested by the student unions, and was intended to keep Kelly from speaking at a university Senate meeting where university president Allan Rock spoke to defend U of O’s freedom of expression practices in the wake of the Coulter fiasco:

Kelly had sent a mass email to students inviting them to attend Senate using this striking video link:
http://www.marckelly.tv/monday/

The arrest was only days after Kelly was freely allowed into the same building to speak and to introduce free speech legal expert Doug Christie.

“Marc is being treated like a terrorist and exiled from the community so that Rock can have his damage-control media show uninterrupted” said university student Senate member elect Joseph Hickey.

Final solution applied to student Marc Kelly at the University of Ottawa – Neanderthal practice

In our liberal democracies university administrations do not shoot students. They may contrive false criminal charges and encourage police to arrest students [LINK]. They may arbitrarily apply trespass law to bar registered students from their studies and from Xmas parties [LINK, LINK]. And campus police wear bullet proof vests and bash students around. But at Canada’s university the administration does not shoot students.

The worst university administrations can do to “undesired elements” of the student body is what was done at York University in the case of Dan Freeman-Maloy: Unilateral deregistration from the student’s study program combined with an enforced physical ban from campus.

In the case of Freeman-Maloy this led to a legal precedent in the Supreme Court of Canada in which a university president can be sued for malfeasance in public office, and it led to a settlement victory for the student [LINK].

Now the Rock administration at the University of Ottawa has applied this final solution to scholarship mathematics student Marc Kelly. No specific reasons were given.

The administration’s death sentence was delivered by president Rock’s new hand-picked VP-Governance Diane Davidson [see letter HERE].

The administration’s action was vigorously opposed by the student federation’s Student Appeals Centre (SAC) but this protest stirred no visible emotion in the administration’s executive officer for governance [see exchange HERE].

In the latest development, the SAC is supporting an official appeal to the university’s Senate Appeals Committee [see appeal letter HERE].

Will the Rock administration come to its senses and stop attacking students in futile efforts to curb creative political expression?

Why not celebrate and protect student activists instead?

Why not encourage criticism and an open campus atmosphere rather than be this Neanderthal about unconventional student political participation?

The Geneva Conventions and the Universal Declaration of Human Rights are examples of evolution. Why not evolve Mr. Rock? Let us move away from final solutions.
